A lawsuit is a civil action or suit brought in a court of law, involving a claim by one party against another, seeking legal remedy for private matters and disputes. The process begins when the plaintiff files a complaint. The complaint along with a summons is delivered to the defendant who usually has twenty days to respond. The defendant may also file a counterclaim. Both parties now use the process of discovery to gather facts and evidence about the dispute.
At this point it may be possible to use alternative dispute resolutions, such as mediation or arbitration to settle out of court. If this is not possible, the lawsuit will go to trial and be heard by either a judge or a jury. Finally, a judgment will be entered and motions and appeals will be filed if necessary.
